Choking Accidents to Children Lawsuit

Food size, shape, density, flexibility, moisture and the speed of chewing are all factors involved in choking accidents. A baby is especially at risk, of course, because an infant or baby does have the same force to expel stuck matter or lodged foods. This means that restaurants knowingly serving infants and small children should not depend upon the adult to cut and portion the food to safe size.

Children’s snacks should clearly be labeled and perhaps depending upon the laws of each particular State, allergens such as peanuts, seafood, shellfish, shrimp, should be avoided, or there may be w bonafide lawsuit brought by the parent or parents on behalf of the child.

A ladies’ unattended purse provides ample opportunity for choking injuries, as the child may encounter numerous differently shapes objects ranging from pancake makeup applicators to car keys.

Swallowed objects that did not immediately cause choking may be the cause of a child choking later, as the object is vomited or causes the child to choke as the obnoxious object is attempted to be expelled.

A high chair without safety straps, a too big a car seat, may cause the infant to slide down and become wedged against the chair or seat and to be choked by the strap itself.

Obviously, toys that are wrong for the child’s age, come apart, or are able to be separated during or as a result of use are also choking hazards.

Otherwise safe and ordinary toys may change into defective and dangerous children’s toys.
A injured child may choke upon a such a toy when around older children, who do not appreciate the opportunity for danger posed by playing with toys that are inappropriate and unsuitable for those of tender years.
